  1.                          SHAREWARE DISTRIBUTION LICENSE
  2.  
  3.              This  is an agreement between Dave Byter,  the author of
  4.     the shareware program Survey Land Yourself,  Version #  2.53,
  5.         and  Serendipity Systems,  a vendor of shareware disks.   In
  6.         the  paragraphs that follow,  "author" shall refer to  the  above
  7.         author,  "Program"  shall refer to the above version of the above
  8.         program,   and  "vendor"  shall  refer  to  the   above   vendor.
  9.         "Purchaser"  shall  refer  to  the  people  to  whom  the  vendor
  10.         distributes copies of the program for a copying fee.
  11.  
  12.         Article 1
  13.              This  program  is recognized as being copyrighted  with  all
  14.         rights reserved by its author.
  15.  
  16.         Article 2
  17.              This  program  may be distributed only under  the  following
  18.         conditions:
  19.         1) the program and/or any part of it may not be added to, deleted
  20.         from, or modified in an way, except:
  21.              a)that  the  vendor,  may  add  to  the  diskette  one  file
  22.         advertising  their products or services, and may add one  how-to-
  23.         use-this-program file, if such clarification is warranted;
  24.              b)the distribution media may be changed to meet the needs of
  25.         the vendor and the purchaser (i.e. programs on 360K diskettes may
  26.         be  copied onto 720K diskettes, etc.), however, the  program  may
  27.         NOT be copied onto CD-ROM disks under this agreement;
  28.         2)  that  a  sum of greater than $6.00 per diskette  may  not  be
  29.         charged as a fee to copy this program;
  30.         3)   that  15 per cent of all monies collected from the sales  of
  31.         copies  of the program or collected as fees to copy the  program,
  32.         (excluding  only the actual shipping charges to send the  program
  33.         from the vendor to the purchaser,) shall be paid to the author as
  34.         a  distribution royalty and that this distribution royalty  shall
  35.         be paid annually within two weeks of the 31st of December of each
  36.         year.

  38.         Article 3
  39.              The  author  assumes all warranty responsibilities  for  the
  40.         program in accord with the warranty statement on the diskette, if
  41.         any, except that the vendor shall warrant that the diskettes used
  42.         for  copies of the program shall be readable and that the  vendor
  43.         will replace any defective diskettes at his own expense.

  45.         Article 4
  46.              The author will, in a timely manner, provide the vendor with
  47.         updated copies of the program, when available, free of charge and
  48.         this  agreement shall apply to those subsequent  versions  unless
  49.         superseded   by  another  agreement  or  cancellation   of   this
  50.         agreement.

  52.         Article 5
  53.              The  vendor  shall  furnish the  purchaser  with  a  voucher
  54.         attesting  to  the  amount  of money paid as a fee  to  copy  the
  55.         program  and  the  author  shall accept  said  voucher  from  the
  56.         purchaser  and  apply the stated amount as a credit  towards  the
  57.         registration fee for the program.

  59.         Article 6
  60.              This  agreement can be canceled at any time by either  party
  61.         upon written notification to that effect.

  80. Legally, I think that you need an address & date where the contract was
  81. executed, as well as the addresses of the parties of the contract.

  83. I personally encourage vendors to distribute individual files or parts of
  84. files.  I consider this free advertising.  My policy is: Copy and distribute
  85. whatever you want, all I require is that you include my copyright.
